BESTMOW Subscription Agreement

Effective Date: July 28, 2025

This Subscription Agreement (“Agreement”) is entered into by and between BESTMOW, Inc. (“Lessor”) and you (“Subscriber” or “You”). By subscribing to, purchasing, or otherwise accessing products or services provided by Lessor, you agree to be bound by this Agreement.

Lessor reserves the right to amend this Agreement at any time. Updates will be posted at www.bestmow-ca.com, and continued use of the Services constitutes acceptance of any changes.

 

1. Order Acceptance

  • Lessor may accept or reject any subscription order within 15 calendar days of submission.
  • Lessor may require identity verification before accepting an order.
  • If rejected, all payments will be refunded, and any delivered equipment must be returned promptly in original condition.

 

2. Term and Termination

  • Term: Begins on the order date and continues until terminated.
  • Termination by Subscriber: Only permitted after the required commitment period. Early termination may result in penalties or forfeiture of deposits.
  • Termination by Lessor: May occur at any time for fraud, misrepresentation, or breach of this Agreement.
  • Effect of Termination: Equipment remains property of Lessor unless full term is completed. Early termination requires return of the device per Section 3.

 

3. Device Return & Restocking

  • Devices must be returned within 30 days of termination.
  • Devices must include all accessories and be in good working order.
  • Fees apply as follows:
    • U.S.: $299 restocking fee + $29.99 if original packaging missing
    • Canada: $399 CAD restocking fee + $29.99 CAD repackaging fee
  • Failure to return, or excessive damage, may result in charges up to the full retail value.

 

4. Usage & Restrictions

  • For residential, non-commercial use only.
  • Resale, rental, or unauthorized transfer is prohibited.
  • One active subscription per household. Multiple trials/accounts are fraud.
  • Any attempt to bypass ownership restrictions or activation systems is a material breach.

 

5. Payment Terms

  • Monthly payments are due on the subscription anniversary date.
  • Late fees: $25 (U.S.) / $35 (CAD) per incident.
  • Non-payment may result in device deactivation and full retail chargeback.

 

6. Subscription Plans (U.S. & Canada)

United States:

  • Premium Plan: $59.99/month × 24 months + $99 deposit
    • Ownership at 24 payments
    • Early termination before 24 months forfeits deposit
    • Deposit refunded only upon successful completion of full term
  • Gold Plan: $99/month × 12 months + $99 deposit
    • Ownership at 12 payments
    • Deposit refunded only upon successful completion of full term

Canada:

  • Premium Plan: $79.98 CAD × 24 months + $136.26 CAD deposit
  • Gold Plan: $139.99 CAD × 12 months + $136.26 CAD deposit
  • Deposit rules mirror U.S. terms
  • Intro Offer: First month 50% off

 

7. Rent-to-Own / Buy-Out

  • Devices remain property of Lessor until full completion of term.
  • Buy-out option may be offered, calculated as the lesser of:
    1. Remaining subscription balance, or
    2. Early termination fee.
  • Buy-out transfers full ownership; warranties and service obligations end.
  • Lessor may refuse buy-out in cases of suspected fraud.

 

8. Suspension & Collections

  • Accounts 15+ days overdue may be suspended or deactivated.
  • BESTMOW may charge fees for suspension/reinstatement.
  • Delinquent accounts may be referred to collections and reported to credit bureaus.

 

9. Limitation of Liability

  • BESTMOW is not liable for indirect, incidental, or consequential damages (lost profits, property damage, etc.).
  • Maximum liability is capped at the fees paid by Subscriber in the preceding 6 months.

 

10. Intellectual Property

  • All BESTMOW trademarks and branding remain the property of Lessor.
  • Subscriber may not repackage, resell, or transfer devices.

 

11. Waiver & Risk Acknowledgement

  • Subscriber assumes all risks in using BESTMOW devices.
  • Subscriber waives and releases BESTMOW from liability for personal injury, property damage, or economic loss associated with device use.

 

12. Indemnification

Subscriber agrees to indemnify and hold BESTMOW harmless from any third-party claims resulting from:

  1. Misuse of devices,
  2. Breach of this Agreement, or
  3. Fraudulent conduct.

 

13. Warranties

  • Devices and services are provided “as-is” without warranty.
  • Subscriber warrants that all information provided is truthful.

 

14. Governing Law & Disputes

  • This Agreement is governed by the laws of the State of California.
  • All disputes shall be resolved exclusively through binding arbitration in Philadelphia, Pennsylvania.

 

15. Miscellaneous

  • Subscriber may not assign rights without written consent.
  • If any provision is unenforceable, the remainder remains valid.

 

16. Modifications

  • Updated Agreements take effect:
    • Immediately for new Subscribers
    • Within 30 days for existing Subscribers, unless Subscriber opts out in writing.

 

By subscribing, you acknowledge that you have read, understood, and agreed to this Agreement.

BESTMOW Early Unlock Terms & Conditions

Eligibility

This program is available only to BESTMOW users with an active subscription contract.

Unlock Mechanism

Users may unlock their device ownership with a one-time payment of $699:

Upon payment, full ownership of the device immediately transfers to the user;

The existing subscription contract will be automatically terminated, with no further monthly subscription fees charged;

Previously paid subscription fees will not be credited, refunded, or applied as an offset.

Deposit Deduction (if applicable)

If you have previously paid a deposit, you may notify our customer service team before placing your order;

The deposit amount can be applied as a deduction toward the unlock payment;

However, once the deposit is applied as a deduction, it will no longer be refundable under any circumstance.

Refund & Return Policy

Once the unlock payment is completed, it is non-refundable and irrevocable;

After unlocking, the user forfeits the right to return the device or cancel the subscription;

The user will remain entitled to BESTMOW’s standard warranty and after-sales service policies applicable to purchase customers.

Additional Terms

BESTMOW reserves the right, within the limits of applicable law, to adjust, modify, or terminate this program at any time;

Participation in this program constitutes acceptance of the above terms.

Important Notice: By completing the one-time $699 “Early Unlock” payment:
  • Ownership of the device will immediately transfer to the user.
  • The user’s subscription contract will be terminated, and no future monthly fees will be charged.
  • Once the unlock payment is completed, it is non-refundable and irrevocable.
  • The user will no longer be eligible for returns or subscription-based refunds but will continue to receive the standard warranty and after-sales service policies applicable to purchase customers.
  • If you have previously paid a deposit, you may notify our customer service team before placing your order. The deposit amount can be applied as a deduction toward the unlock payment. However, once applied, the deposit will no longer be refundable.
  • This offer is available exclusively to current subscription users. BESTMOW reserves the right to modify or terminate the program at any time.
